Terms of Use (EULA) for Nessa: Wellness AI

By downloading or using the Nessa: Wellness AI mobile application (“the App”), you agree to these Terms of Use. If you do not agree, do not use the App.
1. Scope of License
Nessa grants you a personal, non-exclusive, non-transferable, limited license to use the App on any Apple-branded products that you own or control as permitted by the Usage Rules set forth in the App Store Terms of Service.
2. NOT MEDICAL ADVICE
IMPORTANT: Nessa is NOT a medical device. The App provides AI-powered wellness insights and health data analysis for informational purposes only. It is NOT a substitute for professional medical advice, diagnosis, or treatment.
- Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.
- Never disregard professional medical advice or delay in seeking it because of something you have read in the App.
- If you think you may have a medical emergency, call your doctor or emergency services immediately.
3. AI Services (OpenAI)
Nessa uses third-party AI services (OpenAI) to analyze health data. By using the App, you acknowledge that:
- Data sent to AI is anonymized and encrypted.
- AI-generated recommendations are based on statistical patterns and may not always be accurate.
- You must provide explicit consent before any health data is shared with AI services.
4. Subscription and Payments
- The App offers an auto-renewable monthly subscription (“Nessa Premium”).
- Payment will be charged to your Apple ID account at the confirmation of purchase.
- Subscription automatically renews unless it is canceled at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period.
- You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase.
5. Limitation of Liability
Nessa and its developers shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the App, or from any recommendations provided by the AI analysis.
6. Termination
The license is effective until terminated by you or Nessa. Your rights under this license will terminate automatically without notice if you fail to comply with any of these terms.
